Terms of Service

Spimbl is a closed app for our staff and for the parents and legal guardians of athletes enrolled in our program. Accounts are created by our staff by invitation only. You must be at least 18 years old to have an account. Athletes do not have their own accounts, and children under 13 may never create or use an account.

• Keep your password private and don't share your account with anyone else.
• Tell us right away if you think someone else has accessed your account.
• Keep your contact information accurate so you receive important team updates.
• You are responsible for activity that happens under your account.

When you add or manage information about an athlete, you confirm that you are that athlete's parent or legal guardian (or have their permission), that the information is accurate, and that you consent to us using it as described in the Privacy Policy. You are responsible for keeping your athlete's information, especially emergency contacts and health notes, up to date.

Health information in Spimbl is a convenience, not a replacement for talking to our staff. Please tell your athlete's coach directly about any injury, illness, allergy, or restriction that affects practice or competition.

Staff accounts are for program business only. Staff must keep athlete and family information confidential, use it only for their work with our program, never copy it to personal devices or accounts beyond what their job requires, and follow our Safe Sport and child protection policies. Staff access ends when someone is no longer working with our program.

Spimbl is designed to keep communication about athletes open and transparent. Consistent with the U.S. Center for SafeSport's Minor Athlete Abuse Prevention Policies and USA Gymnastics Safe Sport policy, adults communicate about athletes with parents and guardians, not privately with the athletes themselves.

• Keep messages respectful, professional, and related to the program.
• Don't use Spimbl to arrange private, one-on-one contact between an adult and a minor athlete.
• If you see something in Spimbl that concerns you about an athlete's safety or wellbeing, tell our program leadership right away. Suspected abuse must also be reported to the U.S. Center for SafeSport and, where required, to law enforcement or child protective services.

You agree not to use Spimbl to:

• Harass, bully, threaten, or demean anyone, or post hateful, sexual, or violent content.
• Share another person's personal, contact, or health information outside the app, or with anyone who doesn't have a legitimate program reason to see it.
• Download, screenshot, or repost photos or videos of other people's children outside Spimbl without their parent or guardian's permission.
• Pretend to be someone else, or access an account or information you aren't allowed to see.
• Send spam, advertising, or fundraising messages that our program hasn't approved.
• Upload viruses or harmful code, scrape or copy data in bulk, or try to disrupt, overload, or get around the app's security.
• Break any law, or our program's own policies and code of conduct.

You keep ownership of the messages, photos, videos, and files you add to Spimbl. By adding them, you give us permission to store them and show them within the app to the people they are meant for (for example, a routine video shared with that athlete's coaches and family), for as long as needed under our Privacy Policy.

Only upload content you have the right to share. Don't upload photos or videos that show other athletes in a way their families wouldn't be comfortable with, and never upload images taken in locker rooms, restrooms, or changing areas. We may remove any content that breaks these terms or that we believe is inappropriate.

You choose which notifications you receive (push, email, or text) in the app's settings. If you turn on text messages, you confirm the phone number is yours and agree to receive program texts at it. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not responsible for delayed or undelivered messages.

Spimbl does not replace your registration, waivers, membership agreement, or billing arrangements with our program, which stay in effect on their own terms. If anything in these terms conflicts with those agreements, those agreements control on that point.

Spimbl relies on outside service providers, listed in our Privacy Policy. Some optional features, like the staff Google Drive import and "Get directions" map links, are also covered by those providers' own terms. Spimbl only accesses the one file a staff member selects in Google's file picker.

We may suspend or remove an account at any time, for example when an athlete leaves our program, when staff employment ends, or if an account is used in a way that breaks these terms or puts anyone at risk. You can ask us to close your account at any time by contacting xcelteam@deveaus.com. What happens to your information afterward is described in the Privacy Policy.

Spimbl is provided "as is" and "as available." We work to keep it accurate and running, but we don't promise it will always be error free or uninterrupted. Schedules, scores, and results in the app may contain mistakes, and official meet results are those published by the meet host. Important or time-sensitive matters, especially anything about an athlete's health or safety, should always be confirmed directly with our staff.

To the fullest extent allowed by law, DeVeau's School of Gymnastics is not liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of Spimbl. Nothing in these terms limits any liability that cannot legally be limited.

If you use Spimbl in a way that breaks these terms or the law, you agree to be responsible for any claims, losses, or costs that result, and to reimburse us for them, to the extent allowed by law.

These terms are governed by the laws of the State of Indiana. Any dispute that we can't resolve together will be handled in the state or federal courts located in Hamilton County, Indiana. Before filing any claim, please contact us first so we can try to resolve it informally.

We may update these terms from time to time. When we do, we will update the date at the top of this page, and for meaningful changes we will let you know in the app or by email. Continuing to use Spimbl after a change means you accept the updated terms.
